Unlike General Liability, which is usually written on an "Occurrence" basis, Professional Liability is almost always written on a "Claims-Made" basis. Understanding this distinction is crucial to preventing coverage gaps.
Occurrence Policy (Typical GL)
Covers claims for incidents that happen during the policy period, regardless of when the claim is actually filed. Even if you cancel the policy, you are still covered for incidents that happened while it was active.
Claims-Made Policy (Typical E&O)
The policy must be active BOTH when the alleged mistake was made AND when the lawsuit is filed.
Warning: If you cancel a claims-made policy without purchasing "Tail Coverage," you lose protection for all past work.
